3. Applicability
These General Terms and Conditions apply to all offers from the entrepreneur, distance contracts, and orders between the entrepreneur and consumer.
Before concluding a distance contract, these terms are made available to the consumer. If unavailable at the time, it will be indicated where the terms can be accessed. If the distance contract is concluded electronically, the entrepreneur can provide these terms electronically in a way that the consumer can store them.
If specific product or service conditions apply, these also take precedence over conflicting terms. Should any provisions become void or be voided, the remaining conditions remain in force.
4. The Offer
The offer will include accurate details of the products or services. All images, specifications, and data are indicative and not binding. Any changes in the offer will be clearly communicated to the consumer.
5. The Agreement
The agreement is concluded when the consumer accepts the offer and fulfills any set conditions. If the agreement is concluded electronically, the entrepreneur confirms receipt electronically.
The entrepreneur will take appropriate measures to secure the electronic transmission of data.
6. Right of Withdrawal
Consumers have the right to withdraw from the contract within 14 days after receiving the product. The consumer must notify the entrepreneur within this period in writing or by email, and return the product as per the instructions provided by the entrepreneur.
7. Costs in Case of Withdrawal
The consumer is responsible for the costs of returning the products. Refunds will be processed within 14 days of receiving the returned product or proof of return.
8. Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to certain products, including customized goods or products that cannot be returned due to hygiene reasons.
9. The Price
Prices are fixed for the validity period stated in the offer. Price changes due to VAT adjustments may occur. Any discrepancies in pricing due to errors will not bind the entrepreneur.
10. Conformity and Warranty
The entrepreneur guarantees the product complies with the agreement, specifications, and reasonable standards. The consumer must report defects or incorrect deliveries within 14 days of receiving the product.
11. Delivery and Execution
The entrepreneur will deliver the products promptly, but no later than 30 days unless otherwise agreed. If delivery is delayed, the consumer is entitled to dissolve the agreement.
12. Duration Transactions
If the agreement involves ongoing product or service delivery, the consumer may terminate the contract with notice. This applies unless specific conditions or time limits are agreed upon.
13. Payment
Unless otherwise agreed, payment is due within 7 days of receiving confirmation. In case of default, the entrepreneur reserves the right to charge reasonable costs.
14. Complaints Procedure
Complaints must be submitted within 7 days of discovering the defect. The entrepreneur will respond within 14 days and aim to resolve the issue.
15. Disputes
Dutch law applies exclusively to agreements between the entrepreneur and the consumer. If applicable, the consumer has the right to pursue legal claims within the UK under local law.
